DeWitt Ross & Stevens is Madison’s largest full-service law firm with offices in Madison and Metro Milwaukee.
DeWitt Ross & Stevens Wins Another Victory for Employers in the Area of Non-compete Agreements. In a Wisconsin Court of Appeals decision, a victory was handed to employers in the area of non-compete agreements. The decision states that a stock option agreement between an employee and an employer is not subject to Wis. Stat. § 103.465. The court of appeals decision, following the Supreme Court’s pro-employer decision a year ago, states that Wisconsin’s non-compete statute does not apply to restrictive covenants contained in the stock option agreements that are not tied to the employment relationship. The court of appeals goes on to rule that the restrictive covenant as written is sufficiently reasonable to enforce, outside the context of the statute.
