This approach is based on an agreement between the parties that the case will be handled through a series of cooperative negotiations, as opposed to a series of contested Court hearings. The process involves open communication between the parties as well as open disclosure of all records relevant to the settlement of the case. The parties to a collaborative case agree from the beginning that if either chooses to litigate any issue of the case, both attorneys must withdraw.
