Scott is a Partner and Shareholder at DeWitt. He is the Chair of its Background Screening Practice Group, the Past-Chair of its Labor & Employment Practice Group, and an active member of its Litigation Practice Group.
Scott serves as the “go-to” outside counsel for dozens of consumer reporting agencies, data providers, and background screening software companies. He works closely with them to examine their legal risks, address compliance-related projects, and balance the business side and legal side. Scott helps screening clients to think through nearly every imaginable compliance and risk management challenge, and works with them to strategically address lawsuits and demand letters.
He has played a leadership role in the National Association of Professional Background Screeners (NAPBS), including serving as Co-Chair of the Litigation Avoidance Committee, member of the Best Practices Steering Committee, and member of the Ethics Committee. Additionally, Scott is a regular speaker at national conferences and webinars on “cutting edge” background screening topics.
Besides working with background screening companies, Scott works with employers to create strong background screening programs. Many employers (including Fortune 500 companies) have turned to Scott to draft appropriate written consent forms and adverse action letters, and determine whether they can reject a candidate based upon criminal history, credit history, and/or other background screening information. He has successfully defended employers in lawsuits and administrative actions when their background screening practices have been challenged.
Scott actively advises employers on a wide range of traditional employment issue such as employment applications, employee handbooks, wage practices, non-compete agreements, disciplinary investigations, and terminations. He actively represents companies in various employment and non-employment lawsuits.
